There are many people who have asked time and time again the same question which is whether a credit card company sues a person over the matters of unpaid debt. The answer to this question is a simple yes. Every credit company is allowed to sue a credit card holder if they have in any case not paid their credit card debts in full.

When a person gets sued over the case of credit card debts, the normal thing to do would be to consult with a lawyer who has experience in such matters. However, in this case, that person would be considered foolhardy on the fact that not only they are getting sued over credit card debts but also that person is incurring more and more debts in the form of court costs.

Because of the above mentioned fact, there are some certain steps which a person can attempt to not only get out of the whole legal action but also save money over the costs of court. Some of these steps are described in detail below:

• The first thing a person must do on the receiving of a writ of summons is to contact the credit card company which is suing over the credit card debts. After contacting them a person should make some type of arrangements regarding the payment of money. One thing a person should always do in these times is to come to a settlement that is suitable to the budget.

• The next thing a person should do after settling a payment arrangement with the company is to demand the necessary documents of the whole settlement. The reason for this is that there are some credit card companies which after receiving the payment for the credit card debts still harass the customer to pay the debts.

• If all else fails, then the best thing a person can do as a last resort is to file for bankruptcy. Though a bankruptcy will destroy a person credit score, but this issue will also stop the credit card company from contacting again and also stopping all the legal action against a person.

As many people are aware that there are many people who are every year a target of debts and other such matters regarding this. But there are people who consider themselves to be in more trouble than a normal debtor. These people are the Christians. The reason why this is said so is because, in the Bible it is stated that a person cannot in any case owe something other than love. Because of this matter, there are many Christians that are on the constant lookout for a solution that will solve this kind of dilemma.

For such matters, there is one solution that Christian people can look towards to and which is known as the Christian debt relief company. Because of the fact that these types of companies are known to work with people keeping the understanding of the whole belief of Christianity to its core, these companies can then help those Christians that are facing debt issues and provide them Christian debt relief options. Some of the best things that such companies offer are as follows

• One of the biggest things these companies offer is a number of special classes that they invite Christians to join. In these classes, people are given top knowledge of ideas and solutions that can be used by a person to get out of debts.

• Another thing that the Christian debt relief companies offer is that of credit card consulting. In these consultations, people are given advice on what sort of payment should be made and what kind of budget should be kept in the future

• Finally, these companies also offer people the chance of debt consolidation. In these debt consolidations, the Christian debt relief companies ask the Christian people to loan a certain amount of money. Using this load, a person would then be able to pay off most of the debts in one sweep. In return a person would be only concerned about one payment which can be paid off slowly.

One thing which should be kept in mind is that there are some companies that are not official and legitimate and are known to con people on the matters of Christian debt relief options.

There is not a single person on this planet that has not faced the troubles of debts. Getting into a debt is a situation where a person is unable to pay the money that they have loaned. This often results in many companies taking serious action, which includes legal against that person. Because this is such a large scale situation, there are many people who are looking for safe and easy methods which would enable a person to get out of debt.

There are in fact many different ways by which a person can get out of debt. Some of the best four methods which can be used in this matter of regards are explained as follows:

Cease the increase of debt

The first and the foremost thing a person should do at all cost are to stop increasing the debt by getting more loans. Another thing a person should do to stop the increase in debt is to cancel all the credit cards except for one. If a person has more than one credit card, then it is greatly advised a person cut up the other cards as it can help greatly for a person to get out of debt.

Creation of Budget

The next thing which a person should do is to create a budget on the basis of the record of the expenditures of a person over the last month. It will not matter if the amount of the spending record is too high as the best thing would be to create a budget which can be used by the person to spend wisely.

Calculation of the amount

After creating a budget a person should calculate the exact amount that is to be paid to get out of debt. Other things which should be noted down are to whom the payment is to be sent and other such things.

Payment

After doing all of these steps, a person should then start to slowly pay off all of the required money. Though this may take some considerable time, it will however get a person out of debt.

Your creditors may not wait forever to get back the outstanding dues from you. They will sell off your account to a collection agency, if you keep on missing your regular payments in spite of constant reminders. Debt collectors come into action at this point, as they try to get back the outstanding dues from you. They are professionals who intimidate to extract money from you. You can avoid such extreme forms of harassment in the hands of the debt collectors, if you try to pay off your debts through other relief options like debt settlement or consolidation.

Debts typically result in a lot of stress. The debt collectors make the situation more agonizing for you. However, the Fair Debt Collection Practices Act or FDCPA, in short, restricts the illegal and deceitful debt collectors from harassing you constantly. Read along to know how the FDCPA can assist you to stand up against the illegitimate debt collectors.

The FDCPA restrictions

The Fair Debt Collection Practices restricts your debt collectors in the following ways:

1. The Act limits the hours of phone contact for your collectors. The collectors can call only within 8:00 a.m. to 9:00 p.m., and cannot disturb you at wee hours of the night.

2. The collectors are not allowed to use any abusive or obscene language while making collection calls. They are forbidden to give threats of violence, harm or arrest.

3. The Act prevents your collectors from disclosing about your debts to any other third party, like your employer, neighbor or relatives. Though, they can try to obtain information about your location, they cannot keep on harassing your close ones repeatedly.

4. The collectors will have to stop harassing you, if you have a legal representative acting on your behalf, like a debt settlement attorney etc.

5. The collectors have to identify themselves first, before they start the collection procedure. The Act prevents misrepresentation of your debt amounts, or documents by the debt collectors. In this way, the Act protects you against deception or scams.

6. The Act empowers you to ask for debt validation from your collectors. You can even dispute the debt within 30 days, after receiving the validation notice.

7. The Act even prevents your collectors to cease communication, if you notify them to stop collection procedure.

If you feel that the collectors are not abiding by any of the FDCPA regulations, you can sue them within one year of the violations. The court may penalize the collection agency, if the charges are proved against them, and you might even be awarded for the damages. You can even notify the Federal Trade Commission about the illegal actions that your debt collectors take recourse to, and they may take actions against your creditor or collection agency. You must preserve all documents of correspondence with your debt collectors, if you want to drag them to the court for FDCPA violations.

However, the FDCPA doesn’t impose similar restrictions on the in-house collection departments of banks or other credit issuers. The in-house collectors don’t have to abide by the FDCPA rules while trying to obtain missed payments from their consumers.

In the case if a person is not able to pay off the debts in time then there are only two options which are available to them, Debt management and debt settlement. Though the terms debt management and debt settlement may sound the same, however, they are two entirely different things. The choice of which the person selects depends entirely on the financial situation of the person. One thing which should be made clear at this point is that, though both of them are effective solutions, they however come with some side effects. But to choose which more the reliable one is, then a person should first known the concept behind them.

Debt Settlement:

The concept of debt settlement is such where a person debt is cut down a considerable amount, 40-50% and then settled on a certain amount of money which a person then would have to pay up. This choice may sound very good, but there is a big side effect to it, which is, by using this choice there will be huge negative impact on the credit card score of the person.

The choice of Debt settlement should only be considered when there is no other choice than that of bankruptcy. Though it may sully a person credit card score it will also enable a person to avoid bankruptcy. One thing a person should keep in mind, though, is to use a debt settlement service when coming to a settlement. The reason for this is because most of the credit card companies are assured with this that the person will pay up the settlement on time.

Debt Management:

Debt management is a choice which can be said to be a more reliable but still a person will face some side effects regarding this. In this choice a person using a credit consulting agency lowers the interest rates of a debt. This sort of move makes the debt of a person finish more quickly and the best thing it has is that it does not affect the credit of the person. Another advantage of this would be that a person would stop receiving all kinds of calls from the debt collection agency.

After getting into uncontrollable debts, many people ask themselves whether they consider bankruptcy or a debt consolidation with a settlement company. In order to have a genuine answer to your question, you just need to have a complete knowledge on how debt consolidation program works.

When you are getting into an agreement with a debt negotiation company, actually you are entering into an agreement with them that they will negotiate with each of your individual creditor in order to reduce your debt. This is a genuine benefit for you as you are getting lesser amount of debt that you previously owe, interest payment on this should also be lowered. After the negotiation gets into an end, you’ll then have to pay a lump sum amount to your concerned debt settlement company. They will pay each of your individual creditors and also an administrative fee will be charged by the company for their service.

This service may look beneficial to you but yet there are certain ruinations about which you should remain aware of. These debt settlement companies will enforce you to stop lineal payments to your creditors while they are sending them payments. These payments are not administered mechanically. The payments to your creditors will not be sent out until you provide a certain amount of fee to that particular settlement company. In the meanwhile you are probably be evaluated with late fees by your creditors and also Over The Limit fees if you are already close to your maximum credit card usage limits. The most important drawback is if you have already stopped making payments to your creditors at this particular point of time, you will likely to be sued by your creditors while you are waiting your debt consolidation company to make payment on your bills to them. Unlike with the filling of a bankruptcy you are still legally compelled to make payments to these creditors so when payments are not made, they can receive discernment against you.

There are other disadvantages of using these debt consolidation companies. Although your credit card companies agreed to take a lesser amount from you than you actually owe, the IRS may consider any amount of pardoned debt to be taxable income. This could negatively impact you while you go for filling your income tax return. This is not the case at the time of bankruptcy. Your debts will be acquitted with zero tax significances.

Last but not be the least, the debt consolidation companies work under the assumption that there will be certainly an amount of disposable income left after making all the payments to your creditors but this is not the case in most of the times. As people are actually live in pay check to pay check, you will be bound in a consolidation programme by making payments which you simply can’t yield.

If you are deep in credit card debts and your credit counselor has suggested that credit card consolidation is the only debt help option that will meet your requirement, it is better you abide by the suggestion of the credit counselor. But due to a sudden financial crisis if you have to postpone availing credit card consolidation, it may not go down well with your creditors. It may be so that you were all prepared to enroll for the credit card consolidation program but an accident or a medical emergency requires you to divert your funds to meet the crisis.

Under such circumstances your creditors have the right to chase you for their dues. You can talk to your creditors directly and let them know that you are facing financial crisis. If you don’t let your creditors know about the crisis, they may chase you or sell your debt account to a collection agency. And if your debt account is sold to the collection agency, you have difficult times ahead. They harass you by making calls; sometimes they also call your workplace and don’t be surprised if they use abusive language.

So, there is only one way you can avoid making payments for your credit card debts and that is if you file bankruptcy. Filing bankruptcy will prevent your creditors from coming after you as a result of automatic stay. And as per new federal bankruptcy laws, you need to attend a credit counseling session at least 180 days prior to filing bankruptcy. So, you may not have that much time.

However, if the credit counselor has suggested credit card consolidation as the debt solution you qualify for, it is better not to let this opportunity go in vain. There are many benefits of credit card consolidation and you will be able to manage your debts better. Not only that, you will also enjoy reduced interest rates and lower monthly payments.

If you are not being able to make payments for the credit card consolidation program you enroll for, there are many non-profit credit card consolidation firms that can come to your rescue. These companies taking care of credit card consolidation charge very nominal fees or don’t charge any fees at all. However, make sure you choose the correct credit card consolidation company as there is no dearth of scam artists in the debt help industry.
